DEQ to Study Water Quality at J.M. Bevins Well

An unused water well on the J.M. Bevins Elementary School property will be the subject of a Department of Environmental Quality study.
     Officials recently asked the school board for permission to study the well, which School Superintendent Tommy P. Justus said hasn't been used for 15 years, to compile data on ground water availability and ground water quality.
      "They liked that well, and the ease of getting to it," Justus said of DEQ's request to study that particular well. Any data received from the study should provide information about water issues in Buchanan County, and benefit the state, as well, he said.
      "It will be beneficial to Buchanan County as well as the whole state."
      According to documents provided by the school system, DEQ will purchase, install and maintain approximately $5,238 of real-time data telemetry equipment for use in the well. The equipment will be maintained by DEQ indefinitely or until the site is no longer scientifically valid.

Court Grants One Motion to Dismiss In RICO Case

A U.S. Federal Court judge granted a motion to dismiss request in Buchanan County's RICO case against several parties involved in the Operation Big Coon Dog scandal.
     A motion filed March 13 by attorneys for defendants Kenneth Joseph Stephens, Vansant Lumber Company and K. J. Stephens and Associates, LLC asking for the county's claim for damages in the amended complaint in reference to "diminished public confidence" was granted by Judge James P. Jones Monday.
     Additional motions to dismiss on various other grounds, including a claim that the "pattern element" of RICO is unconstitutionally vague were denied by the court.
     A pre-trial conference was also set for May 27 in advance of the scheduled June 3-5 trial.
     The court also ruled on Monday any additional proposed jury instructions must be filed no later than May 20.
